Ways to challenge the institution's decision in the event that the person considers that his/her right to access information of public interest is violated
Any person has the right to request and receive information of public interest from public authorities and institutions.
According to the provisions of Law No. 544/2001 on free access to information of public interest, as subsequently amended and supplemented, the legal deadlines for responding to such requests are as follows:
- 10 days to provide the requested information of public interest, if it is identified within this period;
- 10 days to inform the applicant that the timeframe specified at point a) above was not sufficient to identify requested information;
- 30 days to provide the information, if it is identified beyond the initial 10-day period specified at point a) above;
- 5 days to issue a written refusal, including the justification for denying access to requested information.
Above deadlines are calculated from the date the request is registered.
Neither the day the request is submitted nor the day the response is due is included in the calculation. If the final day of the deadline falls on a non-working day, it is extended to the next working day.
Conditions applicable for verbal communication of a response are as follows:
- employees within the information and public relations departments are obliged to inform the applicants on the procedures and means of access to information of public interest and can provide the requested information on the spot;
- if the requested information is not immediately available, applicants are advised to submit a written request, which will be handled within the above-mentioned timeframes;
- for verbal requests made by media representatives, the response is typically provided immediately or within 24 hours at the latest.
If a person believes that his/her right to access information of public interest has been violated, either due to an unjustified refusal or failure to meet the legal deadline, he/she may submit an Administrative complaint addressed to the head of the institution. The complaint must be filed within 30 days of becoming aware of the refusal or deadline breach.
The well-argued response to the administrative complaint must be sent within 15 days from the date of registration, regardless of whether the solution is favourable or unfavourable.
If a person believes his/her right, as stipulated by Law No. 544/2001, has been infringed, he/she may file a complaint with the administrative litigation unit of the competent court. Jurisdiction lies either in the court corresponding to the applicant’s domicile or the headquarters of the authority or public institution in question.
